1. Supplemental Resolution approving the form of the commitment letter and the first advance of the proceeds of the loan to the West Virginia Economic Development Authority in an amount of up to $6,000,000 from the West Virginia Water Development Authority acting on behalf of the West Virginia Infrastructure and Jobs Development Council to acquire a water line, water tank and related facilities and appurtenances from Roxul USA, Inc.; and making other provisions as to the loan and note evidencing such loan.

2. Possible other actions with respect to the acquisition of the water facilities, loan and note referenced in the preceding paragraph.

3. Resolution with respect to the sale by the West Virginia Economic Development Authority of a non-controlled access right of way for public road purposes over, through and across certain property located in the East River District of Mercer County, West Virginia and the grant of a temporary construction easement over said property, currently leased by the West Virginia Economic Development Authority to Custom Manufacturing Services Inc., all to assist the West Virginia Department of Transportation, Division of Highways with its Brick Street Bridge Project No. S328-104-1.93 00 Parcel 2.

4. Inducement Resolution with Respect to financing certain facilities by the West Virginia Economic Development Authority for Wolf Run Mining Company LLC (A Subsidiary of Arch Coal, Inc.)
